Cosmetics


Object

  • To ensure safety of components used in cosmetics.
  • To study different cosmetics products for their adverse and toxic effects on body.
  • To evolve promotional policies and monitoring mechanism on the Cosmetics products.
  • To protect the consumer from misleading and exaggerated advertisements.
  • To interact and exchange ideas, notes experiences with experts in different fields And conduct joint studies.
  • To study the suggestions made and problems faced by the stake holders.
  • To educate consumers for safe use of cosmetics.

Acts implemented

The Drugs and Cosmetics Act 1940 and Rules 1945.


Regulate
  1. To grant and renew licences for the Cosmetics Manufacturing Units.
  2. To approve Plan of manufacturing premises for Cosmetics.
  3. To issue various Certificates for Tenders, Exports:
    • No Conviction certificate
    • Performance Certificate
    • Free Sale Certificate
    • Certificate of compliance of Schedule M-II.
  4. To investigate complaints received regarding Cosmetics
  5. To carry out inspections of manufacturing Units
  6. To draw samples of Cosmetics.
  7. To conduct raids for those manufacturing spurious /substandard cosmetics.
  8. To take legal action against the offenders and prosecute
  9. To give approval to personnel as Competent Technical Person for Manufacturing, Testing.
  10. To educate the consumers for the safe use of Cosmetics.

Actions

Sub Standard Cosmetics

If samples are reported to be not of standard quality then depending upon the findings of Government Analyst the action of suspension, cancellation of licences is taken . In case the sample is grossly failing legal proceedings are initiated against all concerned.

Non Compliance of Conditions of Licences.

FDA calls for explanation /issues Show Cause Notice for suspension or cancellation of licenses and wherever necessary files prosecutions.
